I just got off the phone with an AD in Delaware (No Sales Tax There!) who was returning my inquery about purchasing a Breitling. He claims that if I buy a watch from a state with sales tax the sales tax will catch up with me even if it is mailed to a different state. He seemed pretty confident(cocky) with this claim and claimed he has ben doing this for 30 years. Yay. I don't know what to believe. I think he was pulling my chain. Anyone know for sure?


Is one responsible for paying sales tax even if the item is shipped out of state?

Ive heard that you are technically supposed to declare it on your taxes (or something to that effect), but I have yet to hear of anybody who has ever done that. If that was the case, you would have to declare online purchases as well. Do some googling on "use tax" and youll see what im talking about..

BTW, it varies from state to state, though I think every state has a use tax. I read about some law in new york that was being passed (or trying to be passed?) that would force online retailers to collect sales tax for orders shipped to NY, whether they were based in NY or not (it had something to do with advertising on certain sites that did business in NY or something like that)...

Anyways, the guy is BSing you.

A strategy that I have pursued is to develop a relationship with an AD that does NOT have a physical place of business in my state of residence. I then place my orders with this AD by phone.

100% of the time the responsibility will on my shoulders to report "use tax".
