sorry if i sound old fashioned, pedantic, stupid, all of the above...
but it's not because a guy is honest and advertises it as a fake that selling fakes (it does display an imitation of the breitling brand/logo) becomes legal, right?
although he is not ripping of a potential buyer, he is still selling an item that illegally copies a trademark, isn't it?

Yes, but if Breitling don't care, and eBay don't care, and the risk of anyone being deceived is zero, then the general perception here is that we are better off focusing on the people who may get ripped off.

No one here is being paid by eBay or Breitling to protect copyright.
