I've been discussing this with a lawyer and my cousin who is in law school, can Rolex (or any manufacturer) confiscate your stolen watch if you didn't knowingly purchase a stolen watch? If you purchase a $10k watch for $1k then it can be proven that you should have known, but what if you paid $7k for it and had no clue that it was stolen?

Not sure if this example is directly equivalent, but when I first came to Canada 15 years ago I bought a used car from a dealership that had taken it as a trade in and about 3 months later I had a phone call from the police in Alberta (we were in Ontario) asking where we had bought it, did we have paperwork, etc because it had been stolen.

We were told that we were fine but that if the dealership hadn't done everything that they were supposed to then the insurance company could go after the dealership to recover their payout.

In the case of watches my guess is that the insurance company (who will theoretically own the watch having paid out) will write it off rather than go after an individual who can demonstrate that they bought the watch in good faith. I am sure that the buyer would have to provide as much information as possible about who they bought it from to help try to trace it back to the thieves, but I can't see a legitimate buyer being screwed over.

Exactly the point. If I buy a BNIB Gold Daytona on the bay for $5k and it turns out to be stolen, it's my problem. If I buy it for $25k, it's the seller's problem.

With no sarcasm at all, that really is interesting; the more you get "ripped off" and the more naive you are, the greater your chances of prevailing. It's nice that intent is taken into account.

I'm no lawyer, but I think it comes down to whether you should have known - if we had bought the car for 20% of list price from a guy in the bar then we should have recognised that it was dodgy, as we bought it from a dealership for market price using normal practices / forms / etc then we were fine.

With eBay it's harder to judge the reputation of the seller - if a 0 feedback seller sells a watch through a regular auction (i.e. market decides the price) then it's a bit of a gamble but no indication of a lack of good faith on the buyers part.
