Well, that situation is truly horrible; by posting on here, we obviously will take your side, give you the benefit of the doubt, but I have a very sensible way of looking at this; I will take an open mind. We have the following situation:

1. You, the seller, claim to have shipped a genuine Breitling Bentley watch to the buyer.
2. The buyer claims to have received a fake.
3. The buyer has a letter stating the watch he presented to the Breitling dealer was a fake.

Point 3 can be immediately refuted as the buyer may well have had a fake watch ready, so the letter proves nothing; all it proves is that the watch he presented to them is a fake. So this proves nothing. So we are down to the first two points. One is true; the other is false, that is 100% certain. As far as I am concerned, there is only one way where the truth can be proven 100%.

The police need to get hold of the watch that the buyer has received, and take fingerprints from it, and compare to yours. That to me is the only way we can find out who is lying, and who is telling the truth. If your prints are on the watch then it is clear you shipped a fake. As this evidently has not happened, for Ebay to side with the buyer, that as far as I am concerned is an absolute disgrace - even though it may well be true you shipped a fake watch to the buyer. If the buyer states something like prints can't be taken as a lot of people have handled the watch, then, well, tough, if you can't prove the seller has shipped a fake then they are innocent; innocent until proven guilty is how I understand the legal system.

The bottom line is there is no way we can resolve who is telling the truth here, but you are out of pocket by a huge amount of money, when you may well be innocent. I think you need to get legal advice; or at the least get in touch with the press; people need to know about this scam as it appears that Ebay are encouraging this sort of crime. Absolutely out of order.

Yea maybe they can get a forensic scientist to see if his dna is anywhere on the watch. Im sure the police dont have better things to do anyway.

Dude, that is harsh and I feel for you. I would suggest trying to file a mail fraud or internet fraud/theft complaint with the police in HIS city. Depending on resources, they may be able to pay him a visit or make an inquiry. I was able to get a local L.E. to visit a seller that did not ship me something after I had paid. Not the same but it may help you. You may also be able to sue the scumbag for the above charges. Hope it works out. Good luck bro.

Not sure what you can do about this situation. Its messy, and without the Jeweller or EBay being able to go that extra mile to verify the actual watch you sent, I guess settling this one will be a mute point. They believe its now settled. It will never really be settled I think and so is food for thought………..

This truly has big ramifications for both sides of the equation and on a few different levels too.

For one thing, many here on BSF are going to think twice about using external on line selling in the future, unless there is certainty and verification is assured. Hard to do really. Safer here (BSF) to sell, I think.

Secondly, the more this type of rip-off occurs (and believe me, it will), then all those interested in dealing with genuine sellers and buyers will have gone elsewhere. Unfortunately, when you advertise to the widest possible audience, then you will by default, attract those who are less than genuine. And those few less than types will make it harder for the rest. Genuine sellers will be weary and probably choose elsewhere to sell an item knowing they can be ripped off like this. Buyers will be under more scrutiny to verify the buys they made and be asked to submit more evidence of the actual transaction (although this will be hard and even impractical to do).

Its probably not the first or last time this has happened, and without getting in the ear of an official to explain this ridiculous and potentially disastrous setup (not to mention how easy it is to rip sellers off), I can’t see anything happening any time soon.

The best comfort you can take from this is that everyone looking for quality and authenticity will have moved elsewhere and will be trading in more favourable environments.

When Ebay first started, the community on it were actually a very friendly bunch. A lot of the watch sellers actually knew each other. Sadly over the last maybe 7 years or so more and more criminals have taken hold. I've been in similar situations a couple of times and lost big. Paypal being absolute swines to deal with and really not caring. On one occasion i refused to pay back what i allegedly owed through my paypal account waiting further investigation. At that time the account just sat in minus figures for a while, whilst i attempted to contact other authorities. I'm not sure if you can still do this.

I sold a Le Mans in the UK once, within days the ad. had been cloned and was in the USA under another users name. Ebay took nearly the full length of the auction to remove it.


My feedback was and still is impeccable, i'm now incredibly careful in regards to who i deal with, there are LOTS of good sellers and buyers on there, just more and more scum too.

I had a gut feeling we wouldn't and that was one reason I suggested we avoid a feeding frenzy.

Which was a wise suggestion. I wasn't suggesting he post it openly; we all know how that can go. It might have helped him if he had followed your advice of sending you the name, though. Venting might feel good, but ultimately it doesn't get him any closer to solving his problem.

Edit: I see I wrote, "especially if...we recognize the name of the buyer." Poor choice of words on my part, since it looks like I was inviting him to post openly. I meant "we" in the sense that one of us, via PM, might be able to help him.
