Bad news about P/P and I had a similar experience many moons ago although not as expensive.I sold a watch on ebay (only a cheap one )the buyer received it and posted excellent feedback for me,so far so good,nearly 3 weeks later I had an email from P/P saying the buyer wasnt happy as the watch was damaged it had bent hands (how do you bend the hands).The outcome was P/P insisted he got a refund and I did get the watch returned and the hands were bent (but not when I originaly sent it ).I think this shows its not worth the risk selling high value goods on ebay as P/P dont have any staff with common sense.
Hope you get your problem resolved in your favour

I wonder if it is worth paying this low life a personal visit - or of course getting someone to do it on your behalf. I know two wrongs don't make a right but perhaps just having the heartache "explained" to him may make him think before doing it again.

It would also be worth seeing if he lists the watch on ebay - if so buy it back and do exactly the same thing to him.

At the very least name and shame him. I really feel for you.

Good luck with getting some justice - however that may come!

This situation really sucks and is the reason I would never sell something to a person I don't trust and do payment via paypal, too much risk involved.

Sellers have absolutely 0 rights on Ebay. Recently I sold a Leica flashgun SF58 (600€) that I used 5 times and was in mint condition with books, invoice, box, etc... The buyer asks me to ship it without tracking because that way he would save 8€. I refuse because I know if I ship this without tracking PayPal will allways rule against me if the item get's "lost". The buyer is not happy but pay's the shipping with tracking. After a week I receive negative feedback stating that the flashgun was very old and used a lot... This item was only introduced in Europe in early 2010 and it was mint... His way of screwing me over for not granting him shipping without tracking. Contacted Ebay but they told me negative feedback can only be erased if profanity's are used or blackmail... duh :roll: and as a seller it is impossible to give a buyer negative feedback, only positive !!

Well first off let me add my sympathies over whats happened, it really sucks that someone who looks perfectly respectable on eBay would do this to you or anyone else.

But let me also say that the number of honest buyers and sellers far out number the dishonest ones, so please don't paint all buyers as thieves and scammers.

Ive bought a number a high value watches from eBay ($5000+ value) and never had any problems and Ive sold some high value stuff as well.

Its been mentioned in the forum that the first rule of eBay transactions is to buy the seller first, then the item. If you follow that then generally you will be ok. I do go a step further in that I request a verifiable home address and post (zip) code, and I then check on a online map that it matches the buyers stated location and that it matches the delivery or sender address on the Paypal transaction. I also absolutely insist on a landline number, that I then call and check the buyer/seller out on.

While this won't prevent Paypal fraud, you know where the individual lives, and you know how to contact them. That way should anything go untoward you can at least get some police intervention if needed. At the very least it makes people stop and think before doing anything stupid as you actually know where they are!

I like eBay, and I like the opportunities it gives me to acquire things (including Breitlings) at prices that would otherwise not afford. You just can't beat the thrill of wining an auction in the last few seconds, for a piece you've been watching sometimes for weeks.

The last name and shame things got a bit dicey here. Obviously it is the OP's right, but maybe best to first PM name to Admin, a Moderator, or even me.

As for the notion of paying a visit to the buyer, don't do it. Things can get out of hand easily and it is just a watch after all.

I am very sorry for your situation. If you have an address and telephone number then consider legal action - civil and criminal. Most states allow for the award of the prevailing party's attorney fees in contract actions, which this is.

The homeowner's insurance is a must for you to consider. If They pay, then they can turn around and pursue a subrogation action against the buyer.

Don't just get mad and give up based on an initial PayPal decision. This has happened before. Sellers have received a final decision in their favor in identical scams. Be wary of the time limits and conditions of any PayPal appeal.

Not much practical advice that I can add, just a situation that completely sucks.

In terms of the other issues raised here, I have no issue with the name / eBay ID being posted here for information, but past experience has shown that it can lead to some bizarre things happening :!:

Ultimately this is a matter between a seller, buyer and the appropriate authorities and a repeat of events where an individual's business got aggressive phone calls, had things posted online about them, etc is obviously not healthy to put it mildly.

As I say every time that similar topics come up, posts suggesting violence or threatening actions also have the potential to cause difficulties for the person making the post.

hmm i should start a web site, for people to air these greavences and tell these stories complete with ebay names and real names, cause pay pal/ebay won't let that kind of feedback show up.

I had a buyer of a watch I sold say that it was someone else who hacked into their paypal account and bought my watch. Since I'm a verified seller and sold to a verified buyer, even though the guy contested the charge, I never had to refund the proceeds of the sale. Paypal told me that they would handle it. It was a huge headache and the thought of being out $4,000 was painful, I was glad it all worked out in the end.

Very sorry to hear this, I've been through it and it sucks. I don't know if I'll ever sell something on the internet again. It's really sad how many dishonest people are out there.

The problem is isn't e-bay, it's Paypal. Use only wire transfer only; bank to bank or a USPS money order, nothing else......
