feeling a bit annoyed and not sure if i am being out of order (over reacting), someone had a sales ad in the sales corner - i pmed and we agreed a price and i said i would pay in a few hours as i was busy - paid a few hours later, hear nothing for 2 days then get a refund saying the item has been sold to someone else :guns:

Not to stir a hormet's nest :evil: , but that simply isn't right. IF you and he agreed on the deal AND you made the payment THEN IT IS A DEAL.

What is your remedy? As a practical matter you just have to let it go. If it were me :evil: I would need at least 2 days to let it go. In the meantime I :evil: would pull together the PMs/emails that show there was a clear meeting of the minds - offer, acceptance - followed by payment. Then I :evil: would PM that info to Admin and both moderators. (sorry guys :oops: ...not really)

Because if it were me :evil: I would assume the seller got a higher offer after accepting your money and letting you transfer it. When similar situations occurred with me as a seller many times, I stuck to my word. If I gave the buyer 48 hours to transfer the funds and someone else started upping the price, I emailed them to wait. Sometimes I kept getting emails increasing the offer. A couple times I had to email "what part of standing by an agreement with another buyer don't you f#####g understand?!"

If the seller got cold feet and decided to keep the watch, I would be disappointed, but not p.o.ed. Different situation entirely.

IF it were me :evil: or you, I would NOT put the seller's info on this thread!! It will turn into a disaster thread.

Yeah I was never going to name and shame, not getting scammed was a bonus but it is an item that does not come up often and new prices are stupid so it's just annouing

that sucks - I have agreed to a price only to have another later offer come in higher....I have to man up and keep/sell the original deal.
My rep is more important that a few bucks.

I can understand a seller beginning to worry about a buyer making good on the offer. "A few hours" could end up becoming a few days or more, and if there's another buyer who wants the watch and is Johnny on the Spot with the cash, then it becomes a tough call. Did the seller say she was OK accepting payment in a few hours? Assuming she didn't (because if she did, then selling it to someone else is prima facie wrong), then she should have sent you notice that you were in danger of losing the watch and provided you a specific deadline for payment. At the very least, she should have informed you the minute the watch had been sold, so you didn't send money unnecessarily. The fact that she didn't backs up Tom's theory that she ended up getting a better offer after you already paid, which technically is breach of contract. However, as others have said, in the end, just be glad you got your money back and didn't get scammed. I think you have every right to be pissed, and I do sympathize; but it could have been far worse.

As a seller I make time to transfer funds a part of the deal. By paypal it is often "by the end of the day." no fuss, no muss. Then it is my discretion to extend for good cause. If I agree to wait for several hours, I have to honor that. If I don't I may not be Ripping off someone, but aren't I scamming to some degree?

It bugs me to no end to receive numerous increasing offers trying to induce me to breach a deal. Even if I would go with someone doing that, would I be comfortable dealing with that person? It's never happened, but I doubt it.

Good point. If someone asks you to be dishonest with someone else, how can you expect them to be honest with you?

Fair enough. I'm probably biased because I was involved in a sale where the buyer promised to transfer funds "later in the day," then disappeared for a couple of days. I didn't have any alternate buyers lined up, so I was just waiting to see what happened. Ultimately it worked out OK, but if I'd had another buyer ready to go, I certainly would have exercised that option. But this is obviously a different scenario, because the OP did pay on the same day. All I'm saying is I understand a certain degree of skittishness by sellers when they're put on hold by the buyer. I think we can all agree, though, that in this case, the seller didn't act particularly honorably, at least not based on the facts as they've been presented to us.
