So heres the background of the story:

I decided that I would sell a watch on "the bay", assuming that I could get it in front of a large enough audience to really bring some good money. It was a Silver Dial Bentley Motors on bracelet. I had picked it up a handful of months before and decided that the silver dial just wasn't working out for me on that piece. So I put it up for auction. Keep in mind this a watch that I purchased from an AD in Salt Lake City.

The buyer payed $4900 for it. I shipped it USPS Express and insured and when he received it, he claimed it was a fake. I knew it wasn't but I said, "Take it to an Authorized Dealer and have them authenticate it and you will see that it is definitely not fake." So he got a letter from an Authorized Dealer in Houston stating the watch he brought in was fake. I told him that if he returned it I would refund him.

Well he sent me a package back. I opened up the package and found a cheap Chinese replica worth a whole 2 cents! Sure enough, Ebay and Paypal sided with me, but after dealing with the dispute process, he filed a credit card chargeback and Paypal decided that they take my $4900 back out of my checking account.

This has been a three month process during the whole process my money has been tied up, and now I'm out my watch and my $5k. Funny thing about this whole situation is I know the guys name, his wifes name, his bosses name, his phone number, his work phone, his home address and work address, yet the local PD claimed there is absolutely nothing that I can do about it...

Any advice? Tom, I know you are an attorney and probably don't ever deal with criminal law and fraud, but if you or anyone else has an idea as to what I should do at this point to recover from this, I would appreciate the help.

I'm really sorry to hear, I don't understand how someone could do that and wear the watch everyday knowing they stole it from someone.

I'll refrain from using profanity, but those words are the only ones that I know how to use to describe this guy.

There are literally dozens of guys on BSource that know my reputability and know that I would never own or try to sell a fake, but how do you argue that with paypal?

I've been waiting to hear a story like this, I knew it was only a matter of time because it's so easy for a buyer to pretend like they have been scammed with a fake watch.

The only protection I could see is to ship the item from your trusted Authorized Dealer (if they're willing) Otherwise there is no proof that the watch in your photos is the actual watch that was shipped to the buyer. It's your word against the buyer's word and unfortuantely Paypal and eBay tend to favor the buyer over the seller.

Wire transfer with a 48 hold is the best option and only way I will sell moving forward.

This is soooo sleezy we all should have his full name and ebay screen name. Also the city/state it was sent to. Post it on this thread. No street address or email - you don't need to get into some weird harrasment issue. Name and city is fair game.

It will take me all of 30 seconds to tell you if he has a criminal record in any state of the US.


If I were you I would also file a police report in his local jurisdiction. Enough money was involved to make it Felony territory.

In an ideal world I would take my weapon of choice, knock on his door and take back what's yours. Sucks when people abuse a system by pretending to be a victim. This story gets me just plain angry. Good luck!

I'm confused. Paypal and ebay found in your favor, then paypal reversed?? Have you filed another paypal resolution?

I thought it was resolved in your favor but I misread it.


The postal inspecters can be a pretty surly lot. Try them. I'm gambling your motors weighed a lot more than the POS you received back. Did he return it in the same box?? Did he return the Breitling boxes and papers? USPS weighed the box both ways, right? They won't even be close unless he put some lead weights or rocks in there. What were the respective shipping weights????

Out this slimy mother right here on this thread. There is no valid reason not to.

I ask a buyer for references as well. If they just signed up for a forum screen name, I'm even more cautious. I'd prefer not to deal with new members of a forum.

its only a matter of time till ebay screws enough people nobody uses it.

id hire a lawyer and sue him in court, you have his info.
