I know we're getting way OT here, but how does the statute of frauds apply here? Doesnt the SOF only apply to contracts that cannot be completed within one year/livestock/real estate? I dont remember learning anything about it that would apply here.

I don't know the retail price of the item, but thinking back to contracts (I no longer practice - went business-side) way back when, I recall something about contracts for the sale of goods over a certain price threshold not being enforceable without being reduced to writing (in addition to the situations you listed).

Right - in the US each state has a stute of frauds requiring contracts for a certain amount(or any contracts for real property, etc...) to be in writing. About $1000. Detrimental reliance on an oral representation is still available. But it doesn't matter here since the "damage" is miniscule, if anything at all. Now off with this legal jazz, I may still want to sell another watch here someday and my rep is quickly going in the toilet. :x

Youre totally right (well, mostly right). I had a much higher figure in my head than $500 for some reason. I did some reading and apparently the limit has been raised to $5000, although no state appears to have adopted the new amount.

In any event, there is no way the store wont make the OP buy the watch. Even if for some crazy reason they insisted he did, he could whip out the visa, buy it, and return it on the spot as per their return policy. :popo:
