For the price he's charging, why doesn't he just advertise it as a replica and be done with it? Or is that against eBay policy?

Yes it is thats why they try and get past that rule

Exactly that,but the majority of the obvious fakes are usualy overpriced aswell most can be bought for $20 or less,at the end of the day a fake is a fake
