Hi all

As you may know I bought a new high-end Seiko watch (MSRP ~$1k) from an ebay dealer for my brother's birthday. Unfortunately, one of the watch's features (some aspect of the stopwatch) doesn't work correctly and the dealer (greymarket) cannot remedy the problem. My brother is unhappy with this as am I.

The dealer is suggesting that he return the watch to me and issuing a partial refund for the broken feature. My view is that the watch doesn't work as advertised so I am targeting a full refund minus shipping costs. If it gets contentious, I can fight it through the funding credit card / ACH (i.e. get expert 2nd opinion that the watch doesn't work). I've never done that before; does anybody here have experience with that?

I am looking for guidance as to what is reasonable in the watch business in a situation like this.

If it is not working as described I would say you are entitled to a full refund including postage as the seller must have known it was faulty before you bought it I would pursue a full refund

Can't help you on the ACH situation, but to my mind if the watch doesn't work properly then you get your money back - no question.

When the issue with the Martin Braun that I bought was discovered the seller took the position that he wasn't prepared to send it to me for me to get fixed under warranty because he prided himself on the quality of watches that he delivered to buyers - that should be the norm.

In my experience with eBay, when a product doesn't function fully as promoted, they force the dealer to refund the FULL amount. It would be like paying $10,000 for a car and the axle is stuck and won't steer. Sure it works and it runs straight, but it's not fully functional and it's not doing what it was intended to do. Especially if you have in writing from the seller that they know it wasn't "as advertised."

I personally only use PayPal with an American Express card as my backup payment - it's double protection and I've never had a problem. Although in my 12 years of purchasing on eBay, I've only had 2 problems and both were remedied quickly thanks to PayPal's terms of service.

hi there,before you ask for a full refund, what you need to confirm is really the feature "game over" itself, not by your brothers, coz if the dealer receive it and they will check it, if the QC test it as human problem, they won't refund you. if it really original quality problem, of course you will get full refund. :superman: wish you good luck

Amex is the industry leader in customer protection. Always use them when in doubt......

Also: full refund for your watch, don't settle for less.

Use your CC protection. Theyll put the smack down on paypal. When big brother arrives, heads will roll :twisted:
