Second, if the item description outlines that the watch is a replica, and eBay is an international marketplace, eBay is not "endorsing" an illegal activity if it is legal to buy a replica.

My understanding is eBay has a strict policy against the sale of replicas, even when they're listed as such. If it's a fake, the sale is prohibited, period.

Then that is even more reason why it's unlikely eBay would be sued. If they have a strict no-replica policy and a few happen to fall through the cracks due to shady sellers, the only way eBay would successfully be sued is if they knowingly participated.

I've been using eBay for the past 11 years and have only had 1 transaction go sideways and eBay and PayPal responded very quickly. Between their terms of service, customer service, and the advice provided by forums such as this, I am typically very confident in my eBay purchases....and if I'm not, I don't bid.

If they did that, it wouldn't be negligence, but an intentional act, which is a whole other cause of action. Even without intent, it would still be possible for them to be negligent even with their policy, if they weren't doing enough to enforce it, or whatever. But it's a long shot. With the measures you described above, I doubt anyone could make the case.
