Then that is even more reason why it's unlikely eBay would be sued. If they have a strict no-replica policy and a few happen to fall through the cracks due to shady sellers, the only way eBay would successfully be sued is if they knowingly participated.
I've been using eBay for the past 11 years and have only had 1 transaction go sideways and eBay and PayPal responded very quickly. Between their terms of service, customer service, and the advice provided by forums such as this, I am typically very confident in my eBay purchases....and if I'm not, I don't bid.
