I've not been back to the dealership about this because frankly I don't hold out a lot of hope of them doing anything. I'm sure the words "driving style" and "traffic conditions" would be liberally used by them to "explain" it. If I was getting sub-30 then they would have to do something, but at just under 40 they could easily claim I was just driving like Jensen Button.
No, I'll just live with it for now and hopefully get myself back in a proper BMW (i.e. one with a decent-sized engine, and ideally petrol) before too long.
A remap of the electronics of the engine management on their test machine might do something, it may worth a try the next time you visit them. And it doesn't need much time to do it.
It may also depend on the kind of diesel you're using. They're maybe details but you'll be amazed sometimes. It made some difference to me when I switched from 93 to 98 octane for the 325i. The engine in itself doesn't need it but as it is primarily used by my wife in mostly short in-town trips I thought of trying a better quality gas. The economy overcame the higher price, but only by a bit. The engine however gets a better treatment, as it doesn't often get the chance to work longer than 15 to 20 minutes.
