I have to say, all the stories I've read on here make me even more skeptical about buying or selling used watches. If I ever do sum up the courage to buy a used piece, it will certainly be from this site, and from a known member.

let me add my 2 cents & let us try to do something about this.

if sharkman can supply the info about workplace, education (and by this probably a way to find some of his friends), neighbors, relatives etc., why not let them all know what a crook Mr. Jeremy Alcede is ?

I am sure they will all love receiving emails from around the world !

Would be happy to participate and send weekly updates to all his contacts, am quite sure I would not be the only forum member ?

At this point in the process this really does seem like a legitimate insurance claim on your home owner’s policy for theft. You’ve got receipts and pictures and your watch was stolen.

You’ll need a police report which you’ll likely never get if you wait for them to come to you. I might suggest going in to the police station and letting them know that you’re there to file a report for theft and you’re happy to wait as long as it take in their lobby to get that done.

I understand pursuing this screwball but if you’re not getting any help, filing a claim 6 months from now will be tough.

Again, so sorry about this man…

I sold a Navi World to a guy and everything seemed fine until I got a notice from paypal that the guy was filing a chargeback saying it was a fradulant claim. The guy paid right away, signed for the package, and then a month later my paypal account shows $4K in the red. This was well after I transferred the money from paypal to my bank account. I'm a verified seller and the guy was a verified buyer so the paypal seller protection helped me since they said I did all the work I could. I provided paypal with the tracking number which shows the person who signed for the package was the guy who filed the claim. I don't know if paypal had to eat the $4K since the guy was filing the charge with his credit card company, but after about 2 weeks, the case was settled. I got my money, and I'm not sure if the guy got stuck with the bill or his credit card refused to pay paypal.

Well assuming that's the same person, a local newspaper headline of "Deputy Marshal accused of theft" might have an impact.

Again I appreciate all of your help and support especially toms research. I will keep you guys updated as I attempt to proceed with thiamin the moat civilized and judicious manner I know how. I hope to be able to send you all news on the resolution to this sleazy situation.

Also a note for any scammers perusing our forum: grow a pair, earn a respectable living and next time you think about scamming someone, think about how it affects their life and their families. Is $5k a ton of money?, no, but for the average American these days, that's nearly two months salary, buts it's still not enough to lose your integrity over.

So, it looks like for the time being they were claiming you owed them, but they didn't actually get the money? A month later...hmmm...not good. You would think after that amount of time, the buyer was pleased with it. At least it got settled in your favor.

I've always hated that "bay" thing and for sure never trusted it. Never even tried to do any deal, especially for amounts over $100. It isn't the first scam and for sure it won't be the last. That's why I've always thought (since I joined) that the safer bet is to go through BS, for watches. Maybe not completely safe but as safe as it can get.

Justin, wish you this story will have a happy ending as Raymond's did.

Hey, OP, very sorry to hear of this. I have some thoughts after reading the whole thread and clicking that link (above).

- In Texas, everyone has a gun, it's like a state law.
- I had a problem with eBay (billing) and wrote them a letter. It took 4 months for them to address my issues, but finally someone read the letter, called me on the phone, and resolved it with no problems. I suspect PayPal is the same; too much automation and real issues from real people get put on the back burner. If you can find a person to actually talk to there and explain the situation, I suspect that they will resolve it in your favor.
- I agree with the folks here that say you can go ahead and file a police report against him. It might not hurt to hire a lawyer or someone locally to represent you. Yeah, it may be good money after bad, but sometimes peace of mind is worth it. Even if you do get your money back, I'd still pursue a legal case against him. He stole from you, and financial restitution is not all that you deserve.

It won't really be up to him. A prosecutor (whether state or federal) would have to be convinced it's worth going for, and press charges. The standard of proof in criminal cases is reasonable doubt, which is considerably higher than preponderance of evidence in civil matters. That isn't to say it isn't worth looking into a criminal complaint, but it's a tougher sell to be sure. Some food for thought, though: because this is an interstate sale, and done via the U.S. Mail, it's also a federal matter. It might be worth initiating a claim with USPS for mail fraud. There are a number of authorities to which he could report this on criminal grounds.
