++UPDATE++

Sorry it's been so long but we didn't want to post anything till the matter was settled.
I went ahead and lawyerd up and here is the short story of what happened.

Well my lawyer sent UPS about three letters all with ups replying the same and holding there ground of that its not there problem.
At that point the lawyer sent one more letter letting them know he had been hired by me at this point to go to court and they had one last chance to offer a settlement before he placed suit with our local county.

They once again stated there position they were not responsible for fraudulent payments and would have never agreed to such a thing.
Even though it does say it on my receipt.

So suit was filed. Court was today.
Court awarded me final judgement in full of fraudulent check. Awarded me 6% interest.Awarded court cost and attorney fee's


So it does seem there is a little hope out there!! And if pushed hard enough these bullys will be forced to stand for what they promised. :cheer:

I'm glad to hear things worked out for you.

It's a little surprising that a company with the resources of UPS would allow this to get to court.

lol i like your use of "lawyered up". glad it worked out in the end. screw the big corporations that think they can squash the little guys with their fine prints and fancy language.

Nice result. Im not an overzealous lawsuit monger, but it sounds like these guys really misled you and caused you to lose money. Im glad the court saw it the same way. Im actually surprised that UPS's counsel didnt realize this would happen and chose to go to proceed.

Glad it worked out.

Also surprised UPS didn't settle, if only to ensure that they had a sealed agreement that you couldn't talk about.

Yeah once the first letter was sent out we figured they would offer a settlement also. Nope notta just there middle finger up in the air.
Sure was nice to get the last laugh..
Dont really have time to type out the whole story but i tried to work it out before getting a lawyer and to say the least UPS was very nasty to deal with.
