Sorry to hear this. This is always my biggest fear when using paypal. And just a caveat to all of you, Paypal offers NO protection on transactions outside of eBay. Zero. So it doesn't matter if this happened with a US buyer or a Asian buyer. Paypal's position would still be the same and the seller would be on the hook.

I would absolutely follow 9 Irons advice. I believe if you push the right buttons, you will ultimately find that Paypal in responsible for processing the payment.

Its kinda like those signs you see in pay parking lots that say "we are not responsible for theft or damage". They can "say" that, and they can have nice big signs printed to convince you that they aren't responsible, but any lawyer will tell you that they are. Once you pay them to park there, they have a responsibility to provide adequate care for the vehicle. If they can deflect 80% of the claims away from themselves by using these signs, they save a ton of money.

I think Paypal is doing the same thing. They push you and hope you cough up the money. If you do, as many people would, they win. Case closed. If not, and you take a legal approach, I bet they fold.

Best of luck and please keep us posted as I'm sure we can all learn from this.

Mark

I agree completely with this. You have the money, and if they really want to fight ('if' being the key word), make them fight for it. I bet they fold too.

You really should talk to a lawyer. The advice here is good, but I wouldn't want you to get into a bind because of it.

Free advice is worth what you pay for it.

Here's what JUST happened to me: I bought a magazine subscription through a site called "ecrater.com" and it was a 2 year subscription to Business Week for $34. It ended up being a 11 month subscription. I protested it through PayPal, and after 10 minutes of going through all of their screens and questions and whatnot, this is what I got:

Thank You for the Information Provided
Your item is not covered by PayPal Buyer Protection. Thus, we are not able to help you at this point.

However, if more claims are being filed against this seller within the next 180 days we will review this case more closely.

Please contact the seller directly to solve this case. We have to debit the reversal amount as well as a 5 EUR processing fee from your PayPal account.
------------
So you see, their buyer protection is crap as well.

Sorry for the hijack OP. I really feel for you and I wish you luck getting some of your money back. You may also try to contact one of the credit reporting companies and see if they can tell you how this (if you refuse to pay it) may affect your credit history.

FYI all those people you contacted and agencies aren't worth shit on the small scale.

Call a lawyer, yesterday.

Problem is I don't think any proper (non ambulance-chaser type) lawyers in the US will work for less than a couple of grand at a minimum... And when u tell 'em it's internet-based transaction... :guns:

Sorry I can't be more positive.

This is simply untrue. There are plenty of good lawyers out there who will do a one hour consultation with you for their normal hourly rate. You can at least get the basics in an hour.

And, they can have a paralegal draw up a letter with the attorneys letterhead on it for a nominal fee. Often, that's all it takes to make crooks go away.

You know this is one instance where I HOPE to be proven wrong for the sake of the OP. But when I had my eBay stores, there never was anything the lawyers (nor the police, nor eBay, nor PayPal, nor the franchisor, nor...) can ever do for me for all the times I got hit by internet crooks. Hopefully things have changed now... My sincere best wishes OP!

There has to be only one sure fire way of doing business if PayPal received funds are not guarenteed and thats not to bother using them at all!!!

Bank transfer to account used purely for receipt of funds i.e. no credit balance and only release goods once the cash has been transferred to your alternative account!
